ViviFunny Co., Ltd. (“ViviFunny”, ”We”, “Us”or “Our”, )  attach great importance to user’s (“you”, “Your”, “User”, “User’s”) privacy and take protecting User’s privacy as our first principle in the provision of Our services (“Service”) which includes Our Web Site (www.vivifunny.com) and Our mobile phone applications (the “App”). Information or Data We Collect

Browsers or Device Information. 

The data we collect depends on the context of your interactions with us, the choices you make, including your privacy settings, and the products and features you use. The data we collect can include SDK/API/JS code version, browser, Internet service provider, IP address, platform, timestamp, application identifier, application version, application distribution channel, independent deice identifier, iOS ad identifier (IDFA), Android ad master identifier, network card (MAC) address, and international mobile device identification code (IMEI) The equipment model, the terminal manufacturer, the terminal device operating system version, the session start / stop time, the location of the language, the time zone and the network state (WiFi and so on), the hard disk, the CPU, and the battery use, etc.

When you use Our Service, certain third parties may collect information about your device. Third parties that we use to collect data regarding users include:

AppsFlyer (http://www.appsflyer.com), which provides marketing and attribution analytics.

Firebase Crashlytics (http://firebase.google.com/docs/crashlytics), which helps track, prioritize, and fix App stability issues.

Flurry (http://www.flurry.com/), that is mobile app usage analytics platform.

Facebook SDK’, that is software product of Facebook and that collects and processes data according to data use policy available at: http://web.facebook.com/full_data_use_policy;

These third parties may use tracking technologies to collect information about you when you use Our Service. If you have any questions about them, we encourage you to read the privacy policies of these third parties to find out more about how your usage data may be used by them.

Cookie

Cookies are files with a small amount of data that stores limited information about the user of your device, which is sent to your browser from the website you visit and stored on your device.

Our Service does not expressly use these “cookies”. However, Our Service may use third-party code and libraries that use “cookies” to collect information and improve its services. You can choose to accept or reject these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some parts of the Service.

Usage Details. 

We collect information about your activity in our services, which we use to do things like recommend a Content you might like. The activity information we collect may include: Views and interactions with content, Terms you search for, Purchase activity, Platform you share content, and the date, time. If you contact us for feedback or customer service, we will collect the information and material that you submitted, your contact information (such as your phone number, email address), so that we could contact you and answer your questions or provide other customer services to you.

If you do not want us to collect these information, do not use Our Service.

Information or Data You Provide to Us

Permissions we might ask you to authorize

In order to provide you basic features and services and improve the user experience, we need you to authorize the following permissions:

• Album and Camera permissions: for photo or video accessing or shooting;

• Receive notification messages: used to receive messages;

• Gets the current network status: to alert users whether they are currently using the mobile network or determine whether a user’s wifi network is available; 

• Read and write external memory card: for reading and writing files on external memory card for video editing;

Social media information

If you choose to login Our Service via a third-party platform or social media network (for example, Facebook), or otherwise connect your account on the third-party platform or network to Our Service. We may collect information from that platform or network, such as your social media alias, first and last name, number of “friends” on the social media platform and, if depending on your Facebook or other network settings, a list of your friends or connections (though we do not use or store this information). Our collection and processing of the information we obtain from social media platforms is governed by the requirements these social media platforms impose on us in their relevant terms and conditions.

Your content – photo or video

Our service provides the features to animate photos with faces or to modify and edit photos or videos, so when you use these features, you need to provide these original contents. Some of these features are done on your device, and some require the help of the network and servers.

• Local Features, All data is on your device, no network is required, we do not collect any information about your content, and do not involve any risk to your privacy;

• Remote Features, These features require you to upload the content to the server, and the server will process the photos or videos for you. After the server has finished processing, it will return the processing results to you. The whole process takes about 10 seconds to 1 minute, depending on your network conditions. This process only involves processing your content, and we will not collect or retain your content. Your original content and generated content will disappear from the server without leaving any traces.

How We Use Your Information and Data

We use information and data that we collect about you or that you provide to us, including any personal information, to:

• improve our products and services, help us create, develop, operate, deliver, and improve our products and services. For example, we might look at usage trends to make sure Our Service is easy to use.

• establish and maintain your account, if you choose to login Our Service using your social media account; 

• send you marketing and promotional communications;

• process and respond to your inquires or to request your feedback;

• display advertisements to you. If you use the free version of Our Service, we work with advertising partners to display advertisements within Our Service. These advertisements are delivered by our advertising partners and may be targeted based on your use of Our Service or your activity elsewhere online;

• to protect our services for the benefit of all our users, and pre-screening or scanning uploaded content for potentially illegal content. We may use your information for authentication, monitoring account and transaction risks, detection and security prevention, fraud monitoring, archive backup, customer security services, etc.

We will not share any information & data that we have collected from you except for the following events:

• If we are required by law to disclose your information, we may share your information with law enforcement or other competent authorities and any third party, as may be required (e.g., to detect, prevent or otherwise address fraud, security, or technical issues; to respond to claims or satisfy any legal process, subpoena, or governmental request; or to protect the rights, property, or personal safety of our users, its partners, or the general public);

• To improve our product and provide you better service, we also share personal data with vendors or agents working on our behalf for the purposes described in this privacy policy. For example, companies we’ve hired to provide data analytical services may need collect and access to personal data to provide those functions. In such cases, these companies must abide by our data privacy and security requirements.

• If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Company, our customers or others

• May be transferred to another company that has acquired our stock or assets, for example, as a result of a sale, merger, reorganization, dissolution or liquidation. If such a transfer occurs, the acquiring company’s use of your personal information will still be subject to this Privacy Policy;

We process your Information & Data for the purposes set out in this Privacy Policy, as described above. Our legal basis to process your Information & Data includes processing that is: necessary for the performance of the contract with you (for example, to provide you with the services you request and to identify and authenticate you so you may use Our Service); necessary to comply with legal requirements (for example, to comply with applicable accounting rules and to make mandatory disclosures to law enforcement); necessary for our legitimate interests (for example, to manage our relationship with you, to ensure the security of our services, to communicate with you about our products and services); and based on consent by our customers (for example, to place certain cookies and to share your information with third parties for advertising purposes).

In some instances, you may be required to provide us with your Information & Data  for processing as described above, in order for us to be able to provide you all of our services, and for you to use all the features of our Service.

Your Rights

• Turn off marketing communications and other push notifications. You may opt out of receiving marketing-related communications and other notifications. You can turn off notifications sent to you by changing the settings on your mobile device;

• Refuse all or some Cookies & Browser Web Storage. Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. Please note that if you set your browser to disable cookies, the Site may not work properly. Similarly, your browser settings may allow you to clear your browser web storage.

• Opt-out of targeted advertising within the Service. If you do not want us to use the information we collect or you provide to us to serve ads based on the target audience preferences of our advertisers, please contact us using the information in the “How to Contact Us” section below at any time. We do not control the collection or use of your information by third parties to serve interest-based advertising. However, these third parties may offer you a way to opt out of the collection or use of your information in this way. You may opt out of receiving targeted advertising from members of the Network Advertising Initiative (“NAI”) on NAI’s website.

If you are a resident of the European Union, you have certain additional rights with respect to your information under the General Data Protection Regulation (EU) 2016/679 (the “GDPR”), including the following:

• Subject to limitations in applicable law, you are entitled to object to or request the restriction of processing of your Personal Data, and to request access to, rectification, erasure and portability of your own Personal Data. 

• Where the use of your information is based on consent, you can withdraw this consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.

Transfer of Data to Other Countries

We store the information we collect in connection with the Service on Amazon Web Services and Google Cloud Platform. Your personal information may be accessed by our technical support team or service providers in other locations outside of your state, province, or country. We take appropriate steps to ensure that recipients of your Personal Data are bound to duties of confidentiality and we implement measures such as standard contractual clauses. A copy of those clauses can be obtained by contacting us through support@vivifunny.com. If you are located in the European Economic Area, as required by law, you hereby expressly consent to our transfer of your data outside the European Economic Area after your use of the Software and/or Services. You may withdraw your consent at any time by notifying us.

Access Third Parties

On our Services, you may access other websites or applications that are not operated by us. For example, if you click on an advertisement on our Services, you may be taken to a website or application over which we have no control. Such third-party websites or applications may independently request and collect information, including personal information, from you and, in some cases, provide us with information about your activities on those websites or applications. We are not responsible for the practices of, or your use or inability to use, the information contained and/or available through such third-party websites or applications. You expressly release us from any and all liability arising out of your use of such third party websites or applications. The content that you upload to the server for editorial processing will not be stored for longer than is necessary for data processing purposes. Therefore this part of the information will not be stored.

Children’s Privacy

Our Service is not intended for children under the age of 13. We do not knowingly collect personal information from children under the age of 13. If we become aware that a child under the age of 13 has provided us with personal information, we will delete this information from our servers immediately. If you are a parent or guardian and you know that your child has provided us with personal information, please contact us so that we can take necessary action.
